California Penal Code Section 626.9[1] is California's version of the Gun-Free School Zone Act, which operates alongside the federal Gun-Free School Zones Act codified at 18 USC 922(q)[2]. California's statute is broader than the federal law in several respects, particularly regarding who may carry within a school zone and what constitutes the restricted area.
Prohibited Conduct
PC 626.9(b) through (e) establishes the following prohibitions:
- Possession on school grounds (626.9(b)): Any person who possesses a firearm in a place the person knows, or reasonably should know, is a school zone is guilty of a felony
- Possession within 1,000 feet (626.9(b)): The school zone extends to 1,000 feet from the grounds of any public or private school providing instruction in kindergarten through grade 12
- Discharge in a school zone (626.9(d)): Any person who discharges a firearm in a school zone is guilty of a felony, punishable by imprisonment in state prison for three, five, or seven years
Exemptions
PC 626.9(c) through (l) provide exemptions for the following[3]:
- Peace officers, whether on or off duty
- Security guards authorized to carry firearms
- Members of the armed forces acting within the scope of their duties
- Persons with written permission from the school district superintendent or equivalent
- Persons who possess a valid California CCW permit (but not out-of-state permits)
- Persons transporting a firearm in a locked container within the 1,000-foot zone (but not on school grounds)
- Persons who reside within the school zone and are on their own property
- Licensed firearms dealers at their place of business
Interaction with Federal Law
The federal Gun-Free School Zones Act (18 USC 922(q)) provides its own set of exemptions, including an exemption for individuals licensed by the state in which the school zone is located. A California CCW permit satisfies the federal exemption for schools within California. However, California's state statute (PC 626.9) provides its own independent restrictions, and compliance with federal law alone is insufficient. Persons must comply with both the state and federal provisions.
Penalties
Possession of a firearm in a school zone under PC 626.9(b) is a felony punishable by imprisonment in state prison for two, three, or five years. Discharge of a firearm in a school zone under PC 626.9(d) carries enhanced penalties of three, five, or seven years. The court may also impose fines and other conditions. A conviction under PC 626.9 will result in a lifetime firearm prohibition under PC 29800.
